The Habeas Assistance and Training Counsel, along with the Administrative Office of the United States Courts and the California Habeas Corpus Resource Center, are presenting the Tony Amsterdam/NITA trainer for capital post-conviction attorneys March 11 - 14, 20010, in San Francisco, CA. This program includes a case file, lectures on types of claims and strategies for investigating them, hands-on investigation exercises (interviewing jurors, mental health experts, trial counsel, etc), and courtroom-skills lectures and exercises. It is intended to develop and sharpen skills with respect to all aspects of capital habeas work.

A group block has been reserved at the government per diem rate at the Sir Francis Drake Hotel. Information regarding how to make reservations will be provided in your confirmation email.

The Habeas Assistance and Training Counsel, through the Administrative Office of the U.S. Courts’ (AO) Office of Defender Services Training Branch, are pleased to announce the Seventh National Seminar on the Development and Integration of Mitigation Evidence in Capital Cases. This unique training initiative will bring together nationally recognized mental health experts, mitigation specialists, and capital defense attorneys to discuss new developments and recurring issues related to social history investigation and the comprehensive development and integration of mitigation evidence at all stages of representation in capital cases. The program is designed for, and attendance is limited to, 200 people.

PROGRAM DESCRIPTION

This seminar has been held annually since the Supreme Court decision in Wiggins v. Smith, 539 U.S. 510 (2003), which recognized the need for thorough mitigation investigation and acknowledged the importance of the non-lawyer who had compiled the mitigation evidence that was not presented at trial. The Supplementary Guidelines for the Mitigation Function of Defense Teams in Death Penalty Cases (published in 2008), in combination with the ABA Guidelines (rev. 2003), have explained in detail the duties and obligations of counsel and the whole defense team in conducting a thorough social history investigation. This year’s seminar will include presentations on new developments in our understanding of brain development, the impact of in utero exposure to toxins (especially the Fetal Alcohol Spectrum Disorders), working up Atkins claims and extending Atkins protections to other clients with mental disorders and impairments, post- Wiggins legal developments, what’s coming in the DSM-V, and the importance of narrative in presenting mitigating evidence.
